Buying Online Terms & Conditions


These Terms and Conditions (“Terms”) describe the rights and responsibilities of you and us in relation to your purchase of a vehicle through this website. Please read them carefully as they represent a legally binding agreement between you and us (and the finance company if you buy on finance). Any purchase of a vehicle on this website is subject to these Terms. The contract between us is concluded in English.

Ordering your car online

On our website you can search our range of new and used vehicles. Once you have made your choice, you can pay for your car outright, or finance it by applying for a finance package online. You can part-exchange your existing vehicle and put the money towards the deposit for your new car. There is also an option to reserve a car for up to 24 hours by paying a fully refundable deposit on it.

The prices displayed on our site are inclusive of VAT.

At the beginning of the order process, you will be asked to confirm your preferred payment method (PCP, HP, Pay in Full, Reservation Fee). Once you have selected your car, you will then receive a quote based on your preferred payment method (but you can also choose to review quotes for other methods).

You must be at least 17 years of age to purchase a car from Prestige Cars Kent. If you are applying for finance you must be over 18 years of age, subject to lender and status.

If you decide to proceed with your purchase and you have decided to pay in full, you will be asked to put in your personal and payment card details to complete the process (see the ‘Paying in Full’ section below).

If you choose to purchase a vehicle and you have selected a finance option, you will be asked to complete a finance application online (see the ‘Buying with Finance’ section below).

If you decide to reserve a vehicle by paying a reservation fee, you will be asked to enter your personal and payment card details (see the ‘Paying a Reservation Fee’ section below).

Buying with Finance

If you decide to place an order and buy on finance, you will be asked to enter your personal details and address, and then fill in a finance application online. You must be over 18 to apply for finance, and acceptance is subject to status. In some circumstances a guarantee may be needed.

When you click “submit application”, we send your information to Alphera Financial Services (BMW Financial Services (GB) C/O Alphera Financial Services via Codeweavers (our finance technology provider) who will review your eligibility for the finance package requested. As part of this review, The finance provider will carry out a hard search (also known as a credit application check), this is when a lender takes a full look at your credit report (and score). Please note that if you apply for a finance package but are unsuccessful this may affect your credit rating and/or credit score. The same applies if your application is successful but we are unable to confirm your order, and you choose not to proceed with an alternative vehicle.

If your finance application has been successful you will be notified on screen, but please note that this does not mean that your order has been accepted. Your order merely constitutes an offer to enter into your chosen finance package, subject to these Terms and the terms of the finance agreement. Even if your finance application is approved, there may be circumstances in which we are unable to accept your order. If this is the case, we will inform you of this by email. This might be because the vehicle has already been sold, because we have identified an error in the price or description of the vehicle, because we are unable to meet a delivery deadline you have specified or because we suspect the transaction may be fraudulent.

If your application has not been successful we will contact you verbally to advise the application has not been successful and we will attempt to get the application approved with an alternative lender.

We will be in touch with you by email or phone regarding the next steps required to complete your purchase. These steps will include signature of your finance agreement, payment of any deposit, and if applicable, arrangements regarding the part-exchange of your vehicle. We require a physical driving license as proof of certification. Identification forms depend on different lenders; usually a driving license is sufficient however some lenders require more information which can consist of bank statements and utility bills dated within the last 3 months.

Once we and Alphera have confirmed acceptance of your offer, you will be sent an order confirmation by email. At that point a contract will be formed between you, us and Alphera for the finance and use of your new vehicle. stage?

Our Financing Methods

Paying in Full

If you decide to place an order and pay in full, you will be asked to enter your personal details, address and payment card information. When you click on “Submit Payment”, the full purchase price will be debited from your payment card immediately.

After placing an order, you will receive an email from us that acknowledges our receipt of your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy the vehicle. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms all of the relevant details of your order (the "Order Confirmation"). The contract between you and us will only be formed when we send you the Order Confirmation. We will inform you of the next steps required to proceed to handover after the Order Confirmation, including arrangements regarding any part-exchange vehicle.

If we are unable to accept your order, we will inform you of this by email. This might be because the vehicle has already been sold, because we have identified an error in the price or description of the vehicle, because we are unable to meet a delivery deadline you have specified, or because we suspect the transaction may be fraudulent. If we are unable to accept your order, we will refund your money in full as soon as possible, usually within 5-10 days.

Paying a Reservation Fee

If you choose to reserve a car by paying a reservation fee, you will be asked to enter your personal details, address and payment card information. When you click on “submit payment”, the amount of the reservation fee will be debited from your payment card immediately.

After paying a reservation fee, you will receive an email from us that acknowledges receipt. Please note that this does not mean that your reservation has been accepted. All reservations are subject to acceptance by us, as we need to check that the car has not already been sold or reserved by someone else. We will confirm our acceptance of your reservation by sending you a confirmation email (the "Reservation Confirmation").

Your vehicle will be reserved for 24 hours. We will be in contact with you to discuss the next steps required to complete your purchase.

If you decide not to purchase the vehicle, you can request a refund of the reservation fee at any time by 01689 660 603, option 1 for sales then option 2. Your payment will be refunded in full, usually within 5-10 days.

Changes to your order

If you decide that you would like to make a change to your car after you have placed the order, please let us know as soon as possible by contacting us at enquiries@prestigecarskent.co.uk. At our discretion we may present you with a new order proposal accommodating the changes. This proposal will take account of any resulting changes to your finance package and delivery/collection date. If you choose to accept the new proposal, your previous order will be cancelled. If you do not communicate your acceptance of the new proposal to us within the required timeframe (7 working days) we will continue to fulfil your original order.

Please note that we cannot agree to all requests for changes to vehicles. We will contact you to discuss possible options in these circumstances, but we will be entitled at our discretion to hold you to your original order.

Your right to cancel

If you have paid for your car in full:

If you are unhappy with your purchase, you have a 14-day cancellation period from the date your vehicle is delivered and you have received these rights.

You will need to fill out and return a cancellation form within the above mentioned 14-day period, a copy of which is attached.

Your refund will be made within 14 days of the vehicle being returned to us. Please also find a copy of the customer complaints procedure listed within these Terms and Conditions. If you change your mind about an order for a vehicle that you have placed online, you can cancel your order at any time before delivery. Please notify us of your decision by sending a clear statement of your intent to the Sales Executive that you have been dealing with or complete a copy of our cancellation form which can be found below.

You may also cancel your order up to 14 days after delivery. However, please note the following important information:

- You must return the vehicle to us at your own expense, or alternatively you can opt to pay us to collect the vehicle from you.

- Although you are entitled to test drive the vehicle on delivery, if the vehicle loses any value as a result of handling by you which is not necessary to establish the nature, characteristics and functioning of the vehicle (for example, if you damage it or run up excessive mileage), we will be entitled to deduct the reduction in value from any reimbursement.

- If you have part-exchanged your old vehicle, we will repay to you the value we assigned to the vehicle as part of your purchase, less any payments we have had to make to clear any outstanding finance. Part exchange vehicles are at the discretion of the dealership and subject to status of preparation.

- If you originally chose to have the vehicle delivered to you, rather than to collect it from us, we will not reimburse any delivery costs.

If you wish to cancel after delivery, please notify us of your decision by sending a clear statement of your intent to manager@prestigecarskent.co.uk or complete a copy of our cancellation form which can be found above. We will reimburse all payments due (subject to any relevant deductions as noted above) within 14 days of the vehicle being returned, using the same means of payment as you used for the initial transaction (unless we agree otherwise between us).

If you have purchased your car on finance via a PCP agreement:

  1. Your options at the end of this agreement

You have the following options at the end of this agreement . (Note: unless stated otherwise. This clause does not apply if this agreement ends early under clause 5).

  2. Keep the vehicle: you must pay the Optional Final Repayment, including the Option to Purchase Fee, if any, on or before its due date. Providing you have complied with all the terms of this agreement and you have paid all other sums payable under or in relation to this agreement, you will then become the owner and can keep the vehicle. Until this time the vehicle remains the property of the lender and you must not sell it.
  3. Part exchange the vehicle: If you want to part-exchange the vehicle, you can do this by paying all sums due under this agreement. You will then become the owner of the vehicle and may part-exchange it.
  4. Return the vehicle:
  5. If you want to hand back the vehicle, you can do this and avoid paying the option to purchase fee, if any, and the optional final repayment. You must give us and the lender 10 days written notice that you want to do this before the optional final repayment falls due (the end date).
  6. If you exercise your right to return the vehicle to us or we end this agreement and have the right to repossess the vehicle, you must make the vehicle available for us or our recovery agent to inspect and collect from you. If you do not return the vehicle to us as agreed with our recovery agent, we will make alternative arrangements to collect the vehicle and you will be charged for each failed collection as noted in the other charges section of the Finance documentation. Our agent will make a written report of the condition and any damage, excess mileage charge and a note of any missing items or documents. We will require proof if you claim that any damage was present or item was missing on the vehicle’s delivery to you at the start of the agreement where the damage or missing item has not previously been notified to us. Until we take possession of the vehicle, your obligations under Clause 4 to take care of the vehicle and clause 5, to insure the vehicle, continue.
  7. We assume the vehicle will be returned in good repair and condition (allowing for recognized industry fair wear and tear standards). The vehicle will be inspected and based on the inspection report, we will charge you a set cost for each item of damage which falls outside of these standards. These charges reflect the cost to us if we decided to have the items rectified. A list of these charges can be found on the lender’s website or you can contact your specific lender if you would like a copy of the current charges.
  8. If the vehicle has exceeded the maximum total mileage, you must pay us the excess mileage charge for depreciation for each mile covered in excess of the maximum total mileage.
  9. You must return the vehicle with all removable items supplied including, but not limited to, the spare ignition key, locking wheel nut key, owner’s handbook, service handbook/record, and satellite navigation disc. The V5C registration certificate and the current MOT Certificate (if the vehicle is over 3 years old) must also be returned with the vehicle or posted back to us at the address provided by the lender. Failure to do so may result in a charge. If our sale of the vehicle is delayed as a result of a missing V5C document or any other missing item, we may charge you for any remaining loss or reducation in value of the vehicle (see under other charges in finance documents).
  10. You must ensure that no personal items are left in the vehicle. If the returned vehicle contains personal affects, we will (at our discretion) either return these to you and charge you our delivery costs or ask you to collect them by arrangement with us. In each case a £12 plus VAT administration fee will also be payable. If we ask you to collect the personal affects and you fail to do so within 30 days of our request, we will be entitled to dispose of them in a manner we reasonably decide without further notice to you. We will credit any sale proceeds towards any money you owe us and pay any balance left over to you.
  11. You will not have to pay the optional Final Repayment.
  12. You must return the vehicle with at least a quarter of a tank of fuel on the date of collection. If you do not, we reserve the right to charge you for the cost of refueling the vehicle with 5 litres of fuel.
  13. If you return the vehicle with a cherished (personalized) registration plate affixed to it and you have not (at your cost) previously applied successfully to the Driver & Vehicle Licensing Agency for retention of the plate, then you irrevocably authorize us to sell the vehicle registration separately).
  14. The charges that you may have to pay if we retake possession of the vehicle are set out under “other charges” in the finance documents.

Right of withdrawal

  • You have the right to withdraw from this credit agreement without giving any reason. This right begins on the day after you receive a copy of the executed agreement and ends 14 days later. If you do not receive a copy of the executed agreement, the 14 days will start on the day after the day on which we confirm in writing that the executed agreement is in identical terms to the unexecuted agreement that was given to you. If you wish to withdraw from this agreement you can write to your lender, the address of which will been written in finance Terms & Conditions. If this is Alphera the address is as follows: ALPHERA Financial Services, Customer Service Department, Phoenix One, 59-63 Farnham Road, Slough SL1 3TN, or email customer.services@alpherafs.co.uk or telephone 03705050125.
  • If you withdraw from this agreement after the credit has been provided, you will need to repay the advance figure plus interest on this amount at the rate shown on the agreement being £8.24 per day up to and including the date of payment. Payment must be made within 30 days starting from the day after you gave the lender notice to withdraw. The lender will keep the advance rental. Once payment has been made in full, ownership of the vehicle will pass to you.
  • You must make your payment to the lender, if this is ALPHERA Financial Services, the payment must be made at the above address. Payment can be made by BACS/CHAPS or by cheque. Please make sure you put your registration number on the payment as a reference.

If you have purchased your car on finance via a HP agreement:

Right of withdrawal

  • You have the right to withdraw from this credit agreement without giving any reason. This right begins on the day after you receive a copy of the executed agreement and ends 14 days later. If you do not receive a copy of the executed agreement, the 14 days will start on the day after the day on which we confirm in writing that the executed agreement is in identical terms to the unexecuted agreement that was given to you. If you wish to withdraw from this agreement you can write to your lender, the address of which will been written in finance Terms & Conditions. Part Exchange

On our website you may obtain a valuation for your current vehicle by entering the registration number. The value of the vehicle may then be applied towards the deposit for the vehicle you are purchasing. If there is finance outstanding on your vehicle, we will settle this and any remaining value will be put towards your deposit. If the outstanding finance is more than the value of your car, you will need to settle it yourself before handover.

You will need to hand over your part exchange vehicle on delivery or collection of your new car. At the same time, you must give us the logbook (V5 registration certificate), service history, MOT certificate (if applicable) and all sets of keys, any private number plates either to be retained or provided. When you hand over your vehicle, the title to it will pass to us.

Our representative will inspect the vehicle before handover. If the condition, mileage or other valuation parameter of the vehicle is not as described by you upon valuation, we will have the right to adjust the value of the vehicle. If this results in a deficit of the amount due to us for your new vehicle, you will be required to make up the shortfall before your new vehicle is handed over to you. We will discuss available options, which may include payment by debit or credit card, or adding the shortfall to your finance (if applicable).

Part exchanges will not be returned if the preparation work has already commenced.

Collection and Delivery

During the online order process, you will be asked to choose how you would like to receive your vehicle. You will be given the following options:

- collection from the dealership where the car is currently located;

- collection from another dealership within the group; or

- delivery to your home address (which must be the same as the billing address for the card used to pay for the car, or the address on your finance agreements, as applicable) charged at £1.32 per mile

Costs and preparation times will be displayed for each option. These are estimated preparation times only and we cannot promise to have the car ready within those timeframes. The actual collection or delivery date will be confirmed by email or telephone.

Cancellation costs are calculated on case by case basis, delivery costs cannot be included in finance figures and have to be paid in full prior to delivery. Please allow for delivery mileage to be added on to advertised mileage.

Handover

Part Exchange

If we have valued your part exchange including service history then this must be present when collecting your new car – failure to do so will result in your part exchange valuation being adjusted accordingly.

In order for us to accept your part exchange vehicle you must be able to evidence that is has at least 3 months MOT and bring with you the most recent V5C registration document in your current name and address.

Please make sure you have signed the part exchange appraisal the Sales Executive has carried out, as any additional damage to your vehicle identified on the day of collection may results in its valuation being adjusted accordingly.

Finance

In all finance cases a UK driving license and two alternative forms of identification may be needed. Please ensure you have these ready.

If you have filled out a finance proposal form with one of our Sales Executives then these details will be uploaded to your chosen lender in order to secure funds for the vehicle.

If you are financing your vehicle with us then we ask that all balances are paid and funds received from the finance company 24 hours before collection.

If your vehicle is being finance by DSG then no deposit will be taken and the vehicle will remain on sale until such time as the proposal is at ‘accepted’ status.

Payments

If you are paying cash for your vehicle we ask that all funds aare received within 72 hours from the point of purchase/vehicle being seen.

No vehicle will ever be handed over without full funds being cleared.

Collection

We respectfully ask that all vehicles are collected within a maximum of 7 days from point of purchase.

If the 7 days is reached without either full payment or collection then your deposit will be automatically returned and the vehicle will go back on sale.

Number Plate Retentions

We will always try to help in regards to number plate retentions, declaring your vehicle as off-road or transferring its status to trader, however it is ultimately the owner’s responsibility for fines, loss of registrations or any other encumbrance regarding your part exchange post sale.

Your Account and Security

You have the option to set up an account on our service if you are buying on finance (“My Account”). This will allow you to access and/or change your saved vehicle and/or finance configurations and update or change your personal details. Where you create an account, you will be asked to provide an email address and password. You may also set up an account with us using your log-in details from third-party services approved by us (e.g. Facebook and Google) and you give us permission to access and use your information from that service as permitted by that service.

In all cases, you are responsible for your account, including making sure that your details are correct and kept up-to-date and ensuring that your password is secure. You are also responsible for all activity that takes place on your account. You must not share your account with any other person. 


Payments

Payments are processed securely by our payment processor partner, Stripe (and its global affiliates). If you are paying in full, or paying a reservation fee, you will need to enter your debit or credit card information. Stripe accepts Visa, Mastercard and American Express. You warrant that you have appropriate authority to use the payment card details which you enter. By entering your debit or credit card information, you agree to use of that information by Stripe for the purpose of paying the amount due and processing your payment.

Warranties and Liabilities

All vehicles purchased from Prestige Cars Kent come with a standard 12 month Prestige Warranty with a £500 claim limit and a mileage limit of 10,000 per year.

We provide the option of purchasing additional warranty plans and extending warranty plans to a Prestige Plus Warranty which increases the mileage limit per year to 14,000 and increases the claim limit to an unlimited amount. A benefit of the Prestige Plus Warranty is that you will be given MOT’s for life until the transfer of vehicle ownership. The Prestige Plus Warranty covers the majority of mechanical and electrical components – as originally covered by the manufacturer’s warranty but extended for up to 5 years.

Other Legal Terms

We will not be liable to you if any failure or delay in our performance under these Terms is caused by circumstances beyond our reasonable control (such as acts of God, war, terrorism or industrial action). No other person has any right to enforce any of these Terms. Any waiver of any provision of the Terms will be effective only if in writing and signed by us. Each of the paragraphs in these Terms operates separately. If any courts or relevant authority decide that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect. Any rights not expressly granted herein are reserved.

These Terms and your use of the Service, including any dispute or claim (whether in contract, tort or otherwise) arising out of or in connection with them, will be governed by English law. We both agree that the courts of England and Wales shall have exclusive jurisdiction over any such dispute or claim. However, we acknowledge that in certain cases, if you are purchasing as a consumer, applicable law may allow you to bring a claim (or be sued) in your own jurisdiction.
